In order to reduce the burden of litigation for those who suffer financial difficulties and protect the parties’ right to litigation, this notice is formulated in accordance with the Civil Procedure Law of the People's Republic of China and the Measures for the Payment of Litigation Fees. Please read the following contents carefully before applying for delaying, reducing and waiving of litigation fees:
12.1. You need to Check the Applicable Conditions of Delay, Reduction and Waiver of Litigation Fees.
12.1.1. If there are any difficulties to pay litigation fees, you can apply to the Court for delay, reduction and waiver of litigation fees in accordance with the law. However, waiver of litigation fees applies only to individuals.
12.1.2. You may apply to the Court for waiver of litigation fees in any of the following circumstances:
(1) Persons with disabilities without a fixed source of income;
(2) Persons who receive payment for alimony, child support, and pension;
(3) Persons living on the minimum standards of living, the special rural hardship relief, or rural five-support, persons receiving unemployment benefits, or persons without any income;
(4) Persons whose own legal rights and interests are damaged due to voluntary actions against injustice or due to the protection of social public interests to the detriment of their own legal rights and interests, and the persons or close relatives seek damages and compensation;
(5) Other situations that require the waiver of litigation fees.
12.1.3. You may apply to the Court for the reduction of litigation fees in any of the following circumstances:
(1) Persons who suffer hardship caused by force majeures and natural disasters and receive social relief, or the person’s family production is unsustainable;
(2) Persons who are subject to care and resettlement as stipulated by the state;
(3) Persons who belong to social welfare institutions and relief management agencies;
(4) Other situations that require the reduction of litigation fees.
12.1.4. You may apply to the Court for the delay of litigation fees in any of the following circumstances:
(1) Persons who receive social insurance payments and economic compensation;
(2) Victims seeking compensation for traffic accidents, medical accidents, industrial accidents, product quality accidents or other personal injury accidents;
(3) Persons who are receiving legal assistance from relevant departments;
(4) Other situations that require the delay of litigation fees.
12.2. If you Meet the above Conditions, the Following Materials shall be Submitted for the Application for the Delay, Reduction and Waiver of Litigation Fees:
11.2.1. The application has no fixed format, but you shall include the applicant's proof of identity and application reasons;
11.2.2. Pay litigation fees or submit the notice of appeals in advance;
11.2.3. Evidence of financial difficulty;
11.2.4. Proof of identity of the applicant, the Power of Attorney authorising the person entrusted and the proof of identity of the agent.
